Introduction

PT FIVE JACK (hereinafter referred to as “itemku” or “Itemku”) is a limited liability company whose one type of its businesses is in the web portal sector. Itemku in this case provides an electronic trading platform (marketplace) that connects among Users, where Users can make products buying and selling transactions, especially for digital products in the form of game vouchers, in-game virtual items, top up games, and others that use various available features and services. Every party residing in the territory can access itemku Platform for later using the features/services, or simply access/visit itemku Platform. As a business supporter and electronic trading platform provider, itemku guarantees security and convenience for Users.

These Terms of Use regulate the use of all Services on itemku Platform which apply to all Users and to each Party who submits requests or information to itemku. By registering to an itemku Account and/or using itemku platform, a User is deemed to have read, understood, comprehended and agreed to all the contents of these Terms of Use.

THESE TERMS OF USE ARE A FORM OF AGREEMENT WHICH CONSTITUTES A BINDING AGREEMENT BETWEEN USER AND ITEMKU. USER CONSCIOUSLY AND VOLUNTARILY AGREES TO ALL PROVISIONS IN THESE TERMS OF USE TO USE THE SERVICES ON ITEMKU PLATFORM

Definition

In these Terms of Use, so long as not otherwise specified, the terms below have the following meanings:

Affiliate is a relationship between a company and a party that directly or indirectly controls, is controlled, or is under the same control of the company.
Account is data regarding User, at a minimum consisting of username, password, telephone number and email which must be filled in by the User.
Terms of Use are an agreement between User and itemku which contains a set of rules governing the rights, obligations, responsibilities of User and itemku, as well as procedures for using itemku Service system.
Itemku Payment System is a payment system facilitated by Partners who collaborate with itemku for Users to make buying and selling transactions in itemku system.
Personal Data is data or information related to User that is identifiable and/or can be identified individually or combined with other information either directly or indirectly through electronic and/or non-electronic systems.
Features are functions, special characteristics, facilities offered or provided by itemku.
The Privacy Policy is the rules that explain the collection, storage, use, processing, transfer and disclosure of User Personal Data by itemku which can be accessed athttps://itemku.com/en/privacy-policy.
Content is any and all material on the Platform, including but not limited to text, data, articles, designs, source code, software, photos, images and other information. Services are collectively: (i) itemku Platform; (ii) any content, features, services and functionality available on or through Platform by or on behalf of itemku, including Partner services; and email notifications, buttons, widgets, and advertisements including collaboration between itemku and third parties for the development of Platform and the development of itemku business activities.
User is a party (registered/unregistered) who accesses itemku Platform, including Buyers and Sellers, clients who are required to comply with itemku Terms of Use and other provisions including but not limited to itemku Privacy Policy, and the terms and conditions of each Products/Services/Features.
Seller is a registered user who sells and/or offers products to users through stores on itemku Platform and is required to comply with itemku Terms of Use and other provisions including but not limited to itemku Privacy Policy.
Buyer is a registered user who purchases Products sold by a Seller on itemku Platform and is required to comply with itemku Terms of Use and other provisions including but not limited to itemku Privacy Policy.
Product Provider or Partner or Provider is a company or third party that collaborates with itemku to provide, sell and/or offer game voucher Products, payment services, network providers or others to Users via itemku Platform and is obliged to comply with itemku Terms of Use along with other provisions including but not limited to itemku Privacy Policy.
Platform is the official sitehttps://itemku.com/or other official sites that can be accessed through a User’s computer device and/or mobile device including platforms of Affiliates, Partners who collaborate with itemku.
Balance is the amount of funds in the User Account (including Store Balance).
Store Balance is the funds stored from the sales of Itemku Seller Products owned by a Seller.
Terms and Conditions are itemku Terms of Use, itemku Privacy Policy and the terms and conditions of each Product/Service/Feature and other provisions that regulate the legal relationship between Users and itemku, Product Providers and/or Partners.
Products are products that can be transacted by Users via Platform, including but not limited to: 1) digital gaming products, i.e. game vouchers, in-game virtual items, and top up games; 2) other digital products aside from games, and 3) physical products related to gaming.
Trade Guard is a feature applied by itemku to provide a security guarantee and a 100% (one hundred percent) money back guarantee to Buyer, where the funds that the Buyer sends to purchase Products will be held until Seller sends the Products that have been purchased by Buyer, as well as the Buyer confirms that the Product has been received (or confirmed as complete by the system if there is no confirmation from the Buyer by a certain time). The seller will be charged additional administration fees for this feature.

Services

General Information
1. By purchasing a top-up or voucher in accordance with itemku Terms of Use, Buyer is responsible for direct top-up or voucher/item that he has purchased.
2. Itemku will not be responsible if User experiences losses in the User’s business (as a Buyer such as negligence or errors in inputting orders or quantities or other data).
3. Itemku can accept refund requests if the order cannot be completed in accordance with applicable provisions.
4. Problems or losses arising after the transaction is completed experienced by either the Seller or Buyer are not the responsibility of itemku.
5. Itemku only allows buying and selling of Products contained in itemku Platform. Itemku is not responsible for transactions made between Sellers and Buyers outside the itemku Platform.
6. The Products traded on itemku are products that are not prohibited by itemku and the applicable laws.
7. Itemku is not responsible for the quality of the Products, Products delivery process, damages to the reputation of other parties and/or any form of disputes that may occur between Users, as all responsibility for the Products lies with the Sellers.
8. Itemku has the authority to carry out initial screening of Users on itemku Platform, therefore itemku has the right to impose penalties ranging from blocking User Accounts, ceasing Sales services, and moderation on itemku Platform if deemed necessary from time to time without notification or information to the Account owner, if there are indications such as but not limited to Account misuse, suspicious transactions, and system exploitation. Itemku decision is an absolute decision that cannot be changed/contested by Users.
9. Further provisions regarding itemku products can be viewed in the terms and conditions of each product. By purchasing itemku products, User is deemed to have read, understood, comprehended and agreed to all the contents of the Terms and Conditions.
Payment System
Itemku collaborates with official Payment System Service Providers (Banks and Non-Banks) to provide a payment system to facilitate and secure every transaction that takes place on itemku Platform for Users. Payment methods provided through itemku Platform include:
1. Bank Transfer;
2. Virtual Accounts;
3. In-store Payment (Offline Payment Store);
4. Internet Banking;
5. Direct Debit;
6. Credit Card; and
7. Electronic Money.

Users, Accounts, Security, and Passwords

Mandatory requirements for Users to access services on itemku Platform, include:

Users must be at least 18 years old (unless otherwise determined by applicable laws and regulations). Users who are not yet 18 years old are required to obtain approval from parents or guardians to use and/or access services on the itemku Platform and are responsible for all costs incurred in connection with the use of services on itemku Platform.
Users are required to read, understand and follow all the provisions set out in these Terms of Use.
Users who have accounts on itemku Platform are required to fill in complete personal data according to their personal identity on itemku profile page.
Users are obliged to submit the correct, clear, honest, precise, complete and up-to-date information of Users in order to use itemku Platform from time to time.
Users must understand that detail of User Account information is confidential, and therefore Users will not disclose detail of User Account information to any Third Parties. Itemku or itemku officers will not ask for User passwords (except on page of User itemku Platform when the User logs in to the User Account via itemku Platform on User’s device). Users agree to bear any risks related to the disclosure of User Account information to any Third Parties and are fully responsible for any consequences related thereto.
Users are prohibited from using robots, spiders, processes or means to access services for any purposes, or other automatic devices, including but not limited to monitoring or copying any material contained in the services on itemku Platform.
Users are responsible and obliged to maintain the security of the Account, including but not limited to the use of User e-mail and password.
For the security and convenience of Users, every transaction on itemku Platform is required to use the payment method provided by itemku.
In the event that a User makes a report and/or complaint regarding the services on itemku Platform and/or the Terms and Conditions, each report and/or complaint must be submitted in good faith and with the purpose of resolving the problem.
Users are prohibited from using itemku Platform to violate the regulations stipulated by laws in the territory of other countries.
While using and/or accessing itemku Platform, Users are strictly prohibited from uploading and/or using words, comments, or any contents that contain elements of SARA (Ethnic, Religion, Race and Inter-Group), misleading, slanderous, or defaming, discriminating, degrading or cornering other people, disrupting public order, disrupting society, disrupting public order, vulgar, threatening, harsh words or other matters that can be considered inconsistent with social values and norms and contrary to those determined by the ministry or institution or applicable laws and regulations. In this case, itemku has the right to take the necessary actions for violations of these provisions, including blocking the Account and others.
Users must be responsible for all risks arising in the future due to the information they provide to itemku,
Users must respect the rights of other users by not providing personal information to other parties without the permission of the parties concerned.
Users are prohibited from manipulating the prices of goods listed on itemku Platform for any purposes, including but not limited to defrauding Buyers.
Users are prohibited from using the Services with the purpose of violating the Rules of Use and applicable laws and regulations in the territory or other countries.
Itemku provides Users with access and use of this Platform to the extent expressly permitted by the Terms of Use. In connection with limited license, itemku expressly states that it does not grant any rights or licenses in connection with the use of the Services; rights or licenses that are not expressly granted are owned solely by itemku or other third parties who own the license. The content on the Platform, as well as the software and infrastructure used to provide Content, is fully owned by itemku or its suppliers and providers.
For the security and convenience of Users, every transaction on the Platform is required to use the payment method provided by itemku.
Users are deemed to have been aware of all applicable laws and regulations in the territory in every transaction on itemku, and will not take any action that violates the applicable laws and regulations.
In the event that a User makes a report and/or complaint regarding the services on the Platform and/or Terms of Use, each report and/or complaint must be submitted in good faith and with the purpose of resolving the problem.
While using and/or accessing the Platform, Users are strictly prohibited from posting, uploading, publishing, sending, using and/or transmitting any words, comments, or Content that: (i) infringes, misappropriates, or violates a third party’s patent, copyright, trademark, trade secret, moral rights or intellectual property rights, or rights of publicity or third party privacy; (ii) violates, or encourages any conduct that would violate, any applicable laws or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) contains elements of SARA (Ethnic, Religion, Race and Inter-Group), defamatory, obscene, pornographic, vulgar or offensive; (v) defames, promotes discrimination, bigotry, racism, degrading, corners, hatred, harassment, or crimes against any individual or group; (vi) is politically charged or (vii) promote illegal or dangerous activities or substances or (viii) promotes violence or actions that threaten other people, disrupting public order, disrupting society, harsh words or other matters that can be considered inconsistent with social values and norms and contrary to those determined by the ministry or institution or applicable laws and regulations.
Users are prohibited from using, displaying, associating or mirroring Services or any element within the Services (including layouts and designs of any pages or form contained on a page of the Service), itemku name, itemku Trademark, or other proprietary information of itemku, without written consent from itemku.
Users are prohibited from accessing, damaging, or using non-public areas of Services, computer systems or technical delivery systems of itemku providers.
Users are prohibited from attempting to probe, scan, or test the vulnerability of itemku system or network or breach any security or authentication measures.
Users are prohibited from avoiding, bypassing, deleting, deactivating, damaging, deciphering, or avoiding any technological measures applied by itemku or itemku providers or other third parties (including other users) to protect Services or Content.
Users are prohibited from attempting to access, search, monitor, copy or download Content from Services, through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the likes) other than software and/or search agents provided by itemku or other generally available third party web browsers.
Users are prohibited from distributing viruses or other technology that could harm itemku, interests and/or property of itemku, or government agencies.
Users guarantee that they will not take any action that could affect/degrade/disrupt services, software, hardware, systems, networks used by other Users to access the Platform.
Users are prohibited from using Services to send unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters, or other forms of solicitation.
Users are prohibited from using meta tags or other hidden text or metadata that uses itemku Trademark, itemku URL logo, or itemku product name without written consent from itemku.
Users are prohibited from forging any part of the Transmission Control Protocol (TCP)/Internet Protocol (IP) or header information in any email or newsgroup posting, or in any way use the Services to send altered, deceptive, or false source-identifying information.
Users are prohibited from attempting to decipher, decompile, disassemble or reverse engineer any software used to provide Services.
Users are prohibited from interfering with, or attempting to interfere with, the access of any user, host or network, including by sending viruses, overloading, flooding, spamming.
Users guarantee that they will not take any action that could disrupt and/or have a negative impact on itemku, internet network, infrastructure, itemku products or services or have an adverse effect on the continuity of itemku business activities.
Users are prohibited from using the Services for any commercial purposes for the benefit of any third party or in any manner not permitted by these Terms of Use.
Users are obliged to respect the rights of other users or third parties and are prohibited from collecting or storing any personal information from Services without consent of the party concerned.
Users are prohibited from using Services to impersonate/forge themselves as someone/another party in contraty to the laws to mislead and/or deceive other people intentionally or unintentionally.
Users are prohibited from doing anything else that itemku deems, in our sole discretion, to abuse or negatively impact the Services.
Users are prohibited from encouraging or enabling each individual to conduct one of the above matters.
Itemku fully reserves the right to investigate and prosecute violations of any of the above matters to the fullest extent of the law. Itemku may involve and cooperate with law enforcement authorities in prosecuting Users who violate these Terms of Use. User acknowledges that itemku has no obligation to monitor User access to or use of the Services or Content or to review or edit User Content, however itemku reserves the right to do so for the purposes of operating Services, to ensure User compliance with these Terms of Use, or to comply with applicable laws or orders or requirements of a court, administrative agency, or other government agency. Itemku reserves the right, at any time and without prior notice, to remove or disable access to the Services, including User Content, which itemku, in itemku sole discretion, deems inappropriate, violates these Terms of Use, violates applicable regulations, or is harmful to the Services.
Users will always cooperate with itemku to investigate and determine whether there has been a violation of the Terms of Use or applicable regulations by giving itemku (along with appointed parties and/or independent auditors) the right of access to User personal data and/or devices used by User to open/access the Platform. In this case, the User authorizes itemku to cooperate with the authorities (including but not limited to the police, government agencies, telecommunications service providers, internet network service providers, data center service providers, etc.) without prior approval from Users.
Should in the future a violation is found regarding the Terms of Use or applicable regulations by a User, itemku has the right to take action which itemku deems necessary to maintain the security and convenience of other Users and Services.
Beware of fraud, information, lottery or promotions in the name of itemku. Official information related to itemku can be monitored via the Platform or official contacts of itemku as detailed in these Terms of Use.
Users are prohibited from sending spam messages in any form referring to any features/services on itemku Platform for any purposes.
Users are prohibited from distributing viruses or other technology that could harm itemku, interests and/or property of itemku Users, or government agencies.
Users are prohibited from using itemku Platform for commercial purposes and transferring/selling User Accounts to other Users or to other parties for any purposes.
Itemku is entitled at any time without prior notification to the User to block the use of Platform or Services if the User violates the applicable laws and regulations.
Itemku is entitled to adjust or delete trading information, hold and check Store Balances, deactivate Seller Stores, and deactivate User Accounts that abuse the system or features available on itemku, if deemed necessary.
Users are prohibited from creating large numbers of itemku accounts with the aim of avoiding Purchase limits, the consequences of Terms of Use, and/or other actions that could be indicated as unfair competition. Each itemku user is only allowed to have at least 1 (one) active account.
Users are deemed to have been aware of all applicable laws and regulations in every transaction on itemku, and will not take any action that violates the laws and regulations.
Should in the future a violation is found regarding the Terms of Use or applicable regulations by a User, itemku has the right to take action which itemku deems necessary to maintain the security and convenience of other Users and itemku Platform.
Itemku does not charge Users an account registration fee.
Users hereby declare that itemku is not responsible for any losses or problems arising from misuse of User Account resulting from the User’s negligence, including but not limited to lending or providing access to the Account to other parties, accessing links provided by other parties, providing or showing passwords or emails to other parties, or other User negligence which results in losses or problems with the User Account.
For Users security, itemku recommends that Users change their password from time to time periodically to maintain the confidentiality of the User Account.
Itemku at its own discretion can hold or freeze User Accounts to protect against all risks and losses that arise, if itemku conclude that the User’s actions indicate fraud or abuse in transactions and/or violations of itemku Terms of Use and if the User Account is suspected or indicated to have been accessed by another party.
Users guarantee that the identity/personal data that the Users registered when creating an itemku Account is the User’s own identity/personal data and not that of any party.
Users will always cooperate with itemku to investigate and determine whether there has been a violation of the Terms of Use or applicable regulations by giving itemku (along with appointed parties and/or independent auditors) the right of access to User personal data and/or devices used by User to open/access itemku Platform. In this case, the User authorizes itemku to cooperate with the authorities (including but not limited to the police, government agencies, telecommunications service providers, internet network service providers, data center service providers, etc.) without prior approval from Users.
Users guarantee that they will not take any action that could affect/degrade/disrupt the services, software, hardware, systems, networks used by other Users to access itemku Platform.
Users guarantee that they will not take any action that could disrupt and/or have a negative impact on itemku, internet network, infrastructure, itemku products or services or have an adverse effect on the continuity of itemku business activities.
Users are prohibited from using Services to impersonate/forge themselves as someone/another party in contraty to the laws to mislead and/or deceive other people intentionally or unintentionally.
Users are prohibited from using itemku Platform with the purpose of collecting Users personal data with the aim of violating the Privacy Policy and applicable laws and regulations. Users are prohibited from using logos, images, the display of itemku on User profile photo (avatar), NFT (Non Fungible Token) or for other Users personal interests without prior approval from itemku.

Seller Accounts, Product Creation, and Product Sales

Sellers are responsible for any information created if there is a case of misuse of brand rights and/or permits from applicable laws.
Sellers are only permitted to sell related Products and are not permitted to sell Products listed in the “Uploading Prohibition” on itemku Platform and/or which are prohibited by the laws.
Sellers are required to place products according to the categories and sub-categories on itemku Platform.
Sellers are obliged to fill in the Product description clearly, shortly and concisely according to the category and sub-category chosen by the Sellers.
Sellers are obliged to charge an appropriate, reasonable and accountable price.
Sellers are prohibited from duplicating products by copying text and/or images (if there are images) from other sellers’ merchandise or stores in itemku. If it is found to be duplicated, the duplicated Products will be closed by itemku.
Sellers are prohibited from placing personal bank data in merchandise descriptions for the convenience of all itemku users.
Sellers are only allowed to sell 1 (one) product in 1 (one) merchandise. Selling more than 1 (one) product in 1 (one) merchandise, the seller will be given penalties according to the level of misuse.
Sellers are prohibited from duplicating products in the same game. If it is found to be duplicating, the Seller will be given penalties according to the level of misuse.
Sellers are prohibited from canceling orders on a large scale without clear reasons within a certain period of time and causing a decrease in the quality of the buyer's convenience. If it is found, penalties will be given according to the level of misuse.
All conversations between Sellers and Buyers are allowed only via the message feature provided by itemku. Itemku is not responsible for communications made by Sellers and Buyers outside itemku Platform.
Sellers, in entering merchandise descriptions/messages/ explanation in other information, are strictly prohibited from writing/soliciting negotiable/negotiation prices. If it is found, penalties will be given according to the level of misuse.
Sellers, in entering merchandise descriptions/messages/ explanation in other information, are strictly prohibited from explaining/including price comparisons of their merchandise with other platforms. If it is found, penalties will be given according to the level of misuse.
Sellers, in entering descriptions/images of merchandise/ conversations in the message box feature/description of other information, are strictly prohibited from writing the transaction directly, name of bank, bank account number, via credit, barter, and/or all types of words/sentences that indicate direct transactions. If it is found, penalties will be given according to the level of misuse.
Sellers are prohibited from placing merchandise that does not match their category or a category that is not provided by itemku, and must comply with the sales terms for that merchandise category. If a violation is found, penalties will be given according to the level of misuse.
Sellers are prohibited from placing merchandise that is not permitted on itemku, such as illegal products, cheats, or jockeys (Exception: Itemku allows the sale of jockey services, in accordance with the conditions stipulated by itemku). If Sellers are found to be doing this outside the provisions set by itemku, penalties will be given according to the level of misuse.
Sellers are prohibited from taking actions that could harm the Buyers, such as but not limited to sending phishing links, asking for Buyer Account login data, asking for itemku PIN, asking for direct transactions. If it is found, penalties will be given according to the level of misuse.
Sellers are strictly prohibited from providing or asking for contact in any form, whether in the Message feature, merchandise descriptions, store slogans or merchandise photos. The contacts we referred to include cell phone numbers, contacts to chat applications such as LINE, BBM, or WhatsApp, as well as links to social media or Steam profile/URL Steam Trade Offer.
In connection with Safe Trading, there are fees charged to the Seller on itemku Safe Trading. Fees are adjusted to the product category being sold, i.e. in the case of selling Accounts, Items, Game Currency, Top Up and E-Vouchers. Sellers may refer to the link in Itemku Help Center separately regarding Safe Trading.
Sellers are prohibited from carrying out transactions with the purpose of obtaining a rating or increasing the number of transactions in an unusual way such as purchasing their own merchandise or using another account to make purchases. If it is found, penalties will be given according to the level of misuse.
Sellers are required to conduct Top Up Moderation, Account Moderation, Item Moderation, Game Key Moderation and Jockey Moderation before creating and selling Products in the Top Up, Game Account, Specific Item, Game Key, and Jockey categories.
An active store status will be changed to closed automatically if the Seller does not log in for 4 (four) days or more.
Sellers are prohibited from intentionally changing the status of an order to have been sent without actually sending the order according to the purchase, with the exception of the game Sales category which requires the Seller to first make friends with the Buyer in the game.
In creating stores and merchandises, Sellers are prohibited from using store names that are similar to existing shops, as well as using images and descriptions of merchandise that are the same/resembling other stores in itemku.
New sellers who are still in the Free Sales Fee Trial Period are required to maintain the performance of their stores.
Sellers are prohibited from using itemku’s name as a store name or user name.
Sellers are prohibited from using and modifying itemku logo and itemku digital assets. Either as a store image (no tolerance), or a merchandise image (with a maximum composition tolerance for the use of logo or digital assets of itemku of 20% (twenty percent) from the entire image).
Each seller is prohibited from having more than 1 (one) store with active status on itemku Platform.
Each Seller is prohibited from exploiting the system to achieve certain goals, such as but not limited to gaining access to benefits from other features on Tokoku (for example the 10 minute delivery feature) to make it faster.
Sellers are responsible for sending original and reliable proof of delivery of the order. If the Seller is found to have changed the proof of delivery to make it appear as if the order has been sent, the Seller will be given penalties according to the level of misuse.
For global orders, sellers are required to keep proof of delivery for 30 days from the date the transaction is made. If there is a need for verification by a third party, itemku reserves the right to request proof of delivery for the relevant global order. If the seller is unable to provide valid proof as requested or fails to respond within the given timeframe, itemku reserves the right to process a refund for the transaction.
Stores that have been inactive for 90 days will be permanently closed. Sellers must contact itemku to request reopening their store. itemku reserves the right to reject the request if the seller is deemed ineligible. If the store is allowed to reopen, the seller will be required to go through the moderation process again in order to sell top-up products, accounts, boosting services, RBL items, game keys, and streaming services.

Transactions

Users are required to make transactions using the transaction procedures established by itemku. Buyers make payments using the payment method previously selected by User in the itemku system. When making payments, Users do not disclose their data/information to any party.
When making a purchase on itemku system, User agrees that:
1. Users are responsible for reading, understanding, comprehending and agreeing to the information and description of the entire Product (including but not limited to quantity, value, use, function and so on), before making a commitment to purchase the product.
2. Users enter into a legally binding agreement for the Purchase or payment of Products when Users make Product transactions.
3. Users understand and agree that the availability of goods is the responsibility of Sellers. If the product stock is empty, Sellers will reject the order, and the Purchase payment will be returned to Users.
4. Users understand and agree that all transactions carried out outside the official system or transactions of itemku and/or without the knowledge of itemku (via private networks, messaging, purchases outside of itemku, and/or purchases outside of invoiced collected by itemku) is the Users personal responsibility, and not the responsibility of itemku.
5. Users understand and agree not to submit/disclose proof of transactions made on itemku to parties other than itemku via official itemku communication channels. In that case, if losses occur as a result of submitting or notifying proof of the transaction to the other parties, this is the responsibility of each Buyer.
6. Users understand and agree that all claims submitted after confirmation/automatic confirmation of receipt of goods are not the responsibility of itemku. Losses arising after confirmation/automatic confirmation of receipt of the Product are the responsibility of each User.
7. Users understand and agree that delays in the payment process and additional costs caused by differences in the bank used by Users and the official Account bank of itemku are the Users personal responsibility.
8. Users hereby agree and consent that itemku, in its discretion, may at any time charge additional fees for transactions in itemku system.
9. Users fully understand and agree that all transactions carried out between Users and itemku, other than via itemku Official Account and/or without knowledge of itemku (via private facilities/ networks, messaging, special transaction arrangements outside itemku System or other efforts), are personal responsibility of the User.
10. Users are required to make a transfer according to the total nominal transaction within the time specified in itemku system. If within the specified time Users do not transfer funds, the transaction will be automatically canceled.
11. Each transaction on itemku that uses the transfer method will be subject to a service fee in the form of a unique payment code to simplify the verification process. Itemku is not responsible for losses experienced by Users if they make payments that do not match the billing amount stated on the payment page.
12. If a User makes an unofficial transaction or cheats, itemku has the right to take legal action.
13. Users are obliged to be responsible for their errors or omissions.
In making transactions on Platform, Buyers are required to provide correct data information when placing an order (game ID and/or game character, notes for the Seller, etc.). If there is incorrect information from the Buyer which causes losses to the Buyer himself, then it is not the responsibility of itemku or the Seller.

Promotion

Itemku can hold promotions at any time with terms and conditions determined by itemku. The terms and conditions may vary for each promotional activity. Users are obliged to read and understand carefully the terms and conditions of each promotional activity from time to time.
Each User is only permitted to use 1 (one) Account for each promotional activity. If it is found that a User has created more than 1 (one) Account to benefit from these promotional activities, itemku can take action that is deemed necessary without prior notification to the User. This action may take the form of canceling transactions, canceling vouchers, blocking User Accounts, or legal action if fraudulent acts are found on the part of the User.
Itemku is entitled to cancel transactions related to promotions at any time without prior notification for the convenience of other users and security.
Itemku is entitled to change the terms and conditions of every promotional activity held by Itemku from time to time without prior notification to Users.

Uploading Prohibition

Users are strictly prohibited from uploading contents that contain or have the following characteristics:

All forms of negative contents that can affect the use of itemku Platform.
Entering types/criteria of products that are violated by the applicable laws and regulations.
Virtual items and accounts that are not yet available in itemku.
Virtual items and accounts that are not in accordance with the categories and subcategories in itemku.
Virtual items and accounts that are not allowed and illegal in itemku.
Virtual items and accounts that indicate SARA, insult/defamation, discrimination, pornography, cornering other parties and matters that are contrary to applicable norms.
Logo and all digital assets belonging to itemku to be used and represent itemku without permission from itemku.

Refund and Disbursement of Balances

Users are required to fill in bank account data for the purposes of returning and disbursing balances in itemku.
If there is a return of the balance to Users due to any reason, itemku will refund the transaction funds carried out according to User payment method minus the service fee unless otherwise determined by itemku. Fees related to transferring balance returns to User Balance accounts are at Users’ expense. Without deviating from the provisions of this clause, unless payments by Users are in the form of paylater/credit, the balance will be attempted to be returned to the credit limit.
Itemku at its own discretion may issue a refund to the Users to protect against all risks and losses that arise, if itemku concludes that the Users’ actions, Users are indicated to do fraud or abuse in transactions and/or violations of itemku Terms of Use and if User Accounts are suspected or indicated to have been accessed by other parties. The costs incurred as a result of the Users actions are the Users burden and responsibility.
Itemku is entitled to carry out checking, freezing, postponement and/or cancellations of balance disbursement transactions carried out by Users if violations of the terms and conditions of itemku, cheating, manipulation, deception and/or crime are found.
The checking, freezing, postponement, and/or cancellation of User Balance disbursement transactions carried out by itemku, can be executed within the time period as required.

User Content and Suggestions

Users may post, upload, publish and submit Content. By providing Content through Services or Platform, Users hereby grant to itemku and its users a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free, with the right to sublicense, use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, and otherwise exploit such Content. Itemku does not claim any rights of ownership in such Content and nothing in these Terms of Use will be deemed to limit any rights that Users may have to use and exploit such User Content. Users acknowledge and agree that Users are fully responsible for all Content that the Users provide through Services. Accordingly, Users represent and warrant that: (i) Users are the sole and exclusive owner of all Content that the Users provide through Services or Users have all rights, licenses, consents and releases necessary to grant rights in such User Content, as intended in these Terms of Use; and (ii) neither the User Content nor the User posting, uploading, publication, submission, or transmission of the User Content, nor itemku or its users use of the User Content (or any portion thereof), will infringe, misappropriate, or violate any patent, copyright, trademarks, trade secrets, moral rights or intellectual property rights of third parties, or rights of publicity or privacy of third parties, or result in the violation of applicable laws or regulations.
Itemku welcomes and encourages Users to provide feedback, comments and suggestions for improving the Service (“Suggestions”). Users can send Suggestions by contacting itemku. Users acknowledge and agree that all Suggestions submitted will become the exclusive property of itemku and Users hereby irrevocably transfer to itemku, and agree to transfer to itemku, all of Users rights, titles, and interests in and to all Suggestions, including but not limited to all worldwide patent rights, copyrights, trade secret rights, and other proprietary or intellectual property rights therein. Therefore itemku hereby grants all authority to itemku to take any further actions that itemku obtains, perfect and maintain of intellectual property rights and other legal protections regarding User Suggestions without the Users’ prior consent.

Users Data

Users hereby agree and consent that itemku can collect, use, access, store, and/or process Users data including but not limited to personal information and/or information about the Users’ use of Services on itemku Platform.
As far as permitted by applicable law, itemku (including affiliated companies and official partners who collaborate with itemku) has the right to use all or part of the data obtained and collected from Users through itemku Platform for the purposes of developing and improving quality for Users security and convenience. Details regarding users data are contained in itemku Privacy Policyhttps://itemku.com/privacy-policy.
Itemku is entitled to disclose Users data for legal processes and/or requests from government agencies, law enforcement and other official authorities as determined by the applicable laws and regulations.
Any information obtained by itemku from Users through access to online transaction facilities from time to time will be treated in accordance with the provisions of the Privacy Policy.
Users are fully aware, acknowledge and agree that they will be fully responsible for any losses or claims arising against itemku as a result of incorrect data and information that the Users submits to itemku through these online transaction facilities.
Itemku is entitled to verify the authenticity and validity of User data used by Users to carry out online transactions. Itemku may suspend the use of Account if it is discovered that the information provided by the User is incorrect.

Applicable Laws and Dispute Resolution

These Terms of Use will be governed by and interpreted in accordance with the laws of the Republic of Indonesia, without regarding the conflict of law. Users agree that any legal actions or disputes that may arise from, relate to, or in any way connected with the Services, Platform and/or these Terms of Use will be resolved exclusively through BANI (Indonesian National Arbitration Board) which was established on 30 November 1977 based on Decree of the Indonesian Chamber of Commerce No. SKEP/152/DPH/1977, which BANI regulations are considered to be included in this provision.

Indemnity

User agrees to release itemku from claims for compensation and to keep itemku (including affiliated companies, directors, commissioners, officers, and all employees and agents) from all claims or demands, liabilities, losses, and reasonable legal fees, made by User and / or third parties arising from User errors including but not limited to violations of this Terms of Use, improper use of itemku services on the itemku Platform, violations of third party rights, violations of the Lapakgaming Terms and Conditions and / or violations of the applicable User's laws and regulations.

Penalty

Itemku has the authority to take action deemed necessary against User Accounts, including Accounts that are suspected and/or indicated to be abusing, manipulating, and/or violating the Terms of Use on itemku and not in accordance with the agreed service quality standards in accordance with regulatory provisions, starting from executing moderation, terminating Services, limiting the number of Account creations, limiting or terminating each User right to use the Services, or closing Accounts without providing prior notice or information to the relevant Accounts owners.

Penalties for Sellers
Level 1 Violation:
- 1 (one) time violating the Terms of Use in section “Seller Accounts, Product Creation, and Product Sales” numbers 8, 9, 12, 13, 15, 16, 18, and 27, the Product will be deleted and the Seller’s Tokoku Account will be closed temporarily for 3 (three) days. Tokoku belonging to the seller in question will reopen after the penalty period is over.
- 1 (one) time violating the Terms of Use in section “Seller Accounts, Product Creation, and Product Sales” number 10, will cause Tokoku Account to be temporarily closed for 3 (three) days (closure may be in the form of closing Tokoku Account, or revoking the Top Up Moderation, Account Moderation, Item Moderation, Game Key Moderation and Jockey Moderation). Decisions cannot be contested, and pending orders to be processed will be cancelled.
- Violating the Terms of Use in section “Seller Accounts, Product Creation and Product Sales” number 6, will cause the Duplicating Product to be closed and/or deleted.
- Violating the Terms of Use in section “Seller Accounts, Product Creation and Product Sales” number 24 (similar store names, using the same merchandise images, and selling the same category), which causes the store to be closed and directed to create a new store. If the Seller commits the same violation again, Tokoku Account or store will be closed permanently and the registered account cannot be used again.
- If a new Seller (during the Free Sales Fee Trial Period) cancels orders 2 (two) times out of the first 10 (ten) orders received, the store will be temporarily closed at the earliest until the free sales fee period is over and the Seller can contact itemku User Service.
- Seller who violates the Terms of Use in section “Seller Accounts, Product Creation, and Product Sales” number 28, the Seller will be inquired to inform which store to use, and the other stores will be permanently disabled.
Level 2 Violation:
- 2 (two) times violating the Terms of Use in section “Seller Accounts, Product Creation, and Product Sales” numbers 8, 9, 12, 13, 15, 16, 18, 27, the merchandise will be deleted and the Seller's itemku store will be temporarily closed for 5 (five) days. The store will reopen after the penalty period is over.
- 2 (two) times violating the Terms of Use in section “Seller Accounts, Product Creation and Product Sales” number 10, will cause the store to be temporarily closed for 5 (five) days (the closure may be in the form of closing the store, or revoking the Top Up Moderation, Account Moderation, Item Moderation, Game Key Moderation and Jockey Moderation). Decisions cannot be contested, and pending orders to be processed will be canceled.
Level 3 Violation:
- 3 (three) times violating the Terms of Use in section “Seller Accounts, Product Creation and Product Sales” numbers 8, 9, 12, 13, 15, 16, 18, 27 the Seller’s Tokoku Account and/or itemku store will be permanently closed.
- 3 (three) times violating the Terms of Use in section “Seller Accounts, Product Creation and Product Sales” number 10, will cause the store to be temporarily closed for 7 (seven) days (the closure may be in the form of closing the store, or revoking Top Up Moderation, Account Moderation, Item Moderation, Game Key Moderation and Jockey Moderation). If the Seller violates article 3.10 again (a total of 4 (four) times), the Seller’s itemku store will be closed permanently. Decisions cannot be contested, and pending orders to be processed will be canceled.
- 1 (one) time violating the Terms of Use in section “Seller Accounts, Product Creation and Product Sales” numbers 14, 17, 20 and 26, the Seller’s itemku store will be permanently closed.
- 1 (one) time violating the Terms of Use in section “Seller Accounts, Product Creation and Product Sales” number 23 and the store is not cooperative in providing the evidence requested by itemku and does not have any successful transactions at all, the Seller’s shop will be permanently closed, and the remaining Store Balance will be held for up to 6 (six) months.
- 1 (one) time violating the Terms of Use in section “Seller Accounts, Product Creation and Product Sales” number 30, the Seller’s store will be closed permanently, and the remaining Store Balance will be held for up to 6 (six) months.
General Penalties for All Users
- Any misuse/suspicious transactions/indications of system exploitation may result in Account blocking if necessary.
- All misuse/suspicious transactions/indications of system exploitation may result in reporting to the authorities and to the legal domain if necessary.
- Itemku is entitled to delete information on any part of User or Tokoku, if it contains elements mentioned in the Uploading Prohibition.

Miscellaneous

Under points 1 - 2, the Users agree and consent that Users have the responsibility to maintain the reputation of itemku and its subsidiaries as a trusted electronic trading platform (e-commerce) service provider. Itemku is of the opinion that all acts or attempts on manipulation, crime, fraud, and/or acts of violation of rules committed by Users occurring at or in the use of Platform constitute a serious violation (“User Violation”).

Users state that the losses suffered by itemku (including affiliated companies, directors, commissioners, officers and all employees) as a result of the User Violation have a material impact on the continuity of itemku activities and reputation. Losses occurring as a result of User Violations are difficult or impossible to determine with certainty, and it is also admitted that there are no adequate legal remedies to repair the losses that have occurred as a result of User Violation. Therefore, Users agree that itemku is absolutely entitled to take all necessary actions to restore and protect its reputation and request compensation from Users who committed User Violation for the losses suffered by itemku including but not limited to carrying out checkings or investigations (either alone or in collaboration with the authorities), blocking accounts, deleting content and/or accounts, reprimanding the relevant users, freezing user accounts, compensating for losses suffered by itemku by way of compensation against the funds available in the relevant Users’ itemku balance (“Violation Mitigation Actions”).

Users who commit User Violations waive all rights they have to file lawsuits, claims, objections and/or other process against itemku (including directors, commissioners, officers and all employees) in carrying out Violation Mitigation Actions for User Violations.

The calculation of the amount of loss prepared by itemku in this context is final and binding. Users who are suspected of committing User Violation can contact itemku Customer Service to immediately resolve the User Violation problem within 7 (seven) calendar days after the User in question first receives Violation Mitigation Actions from itemku. Itemku actions in carrying out Violation Mitigation Actions will never eliminate or be interpreted as limiting itemku rights to take other measures available under applicable regulations.

Termination/Change of Services and Third Party Services

Itemku (including affiliated companies, directors, commissioners, officers, as well as all employees and agents) is not responsible, and Users agree not to hold Itemku responsible for any damage or loss (including but not limited to loss of money, reputation, profits, or other intangible losses) resulting directly or indirectly from the use of third party services that Users access through itemku Platform. Users are advised to read carefully the terms and conditions provided by these third parties.
Itemku can deactivate a User Account or suspend a User Account at any time for any reason, especially for misuse of the system or other matters that violate the Terms of Use provided by itemku.
Itemku has the authority, without being required to provide notification to Users, to postpone, cease or cancel Users transactions via online transaction facilities if itemku knows or considers that the Users’ transactions will be used for matters other than what they are intended to.
Itemku has the right from time to time to change/cease/suspend Services and/or third party services without Users consent/notification.
Services may contain links to third-party websites or resources. Users acknowledge and agree that itemku is not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the text, products or services on or available from such websites or resources. The content of links to such websites or resources does not imply any endorsement by itemku of such websites or resources or of the text, products or services available at such websites or resources. Users are responsible and assume all risks arising from the use of such websites or resources.

Disclaimer of Warranties and Limitation of Liability

Itemku will continue to strive to maintain the quality of itemku services to remain safe, convenient and functioning well, however itemku cannot guarantee that continuous operation or access to itemku system will always be perfect. Information and data in itemku System may not occur in real time.
Services may contain technical or other errors, inaccuracies or typographical errors. Itemku can make changes to the Services on the Platform, including prices and descriptions of Products listed on the Platform, at any time without prior notification.
The use of Services or downloading or acquisition of any other Content through this Platform is at the Users own will and risks and with the agreement that Users will be fully responsible for any damage to your computer system or loss of data that occurs as a result of such activities.
Users understand and agree to the limit of itemku responsibility proportionally as a Product provider, therefore it is only limited to the value of the goods or Products transacted.
If Users have a dispute with one or more other Users, the Users release itemku (including the parent company, board of commissioners, board of directors, and/or employees) from claims and demands for damages and losses (actual and implied) of every kind and nature, known and unknown, arising from or in any way connected with the disputes. In this way, the Users deliberately waive any legal protection (contained in laws or other legal regulations) which would limit the scope of this waiver provision.
Users agree and are aware that Users utilize itemku Services on itemku Platform at the Users’ own risks, and itemku Services provided or the itemku Products offered to Users are as appropriate and as available.
To the extent permitted by applicable laws, itemku (including affiliated companies, directors, commissioners, officers, as well as all employees and agents) is not responsible, and Users agree not to hold itemku responsible for any damage or loss (including but not limited to loss of money, reputation, profits, or other intangible losses) resulting directly or indirectly from:
1. Users’ use or inability to use itemku Platform;
2. Price, Delivery or other instructions available on itemku Platform;
3. Delays or interruptions in itemku Services;
4. Negligence and losses incurred by each User;
5. Information written by itemku users, whether product providers, users or third parties;
6. Violation of Intellectual Property Rights (copyright, trademark, industrial design, circuit layout design, and/or patent rights) or other personal rights attached to a Product;
7. Violation of the applicable laws and regulations;
8. Disputes between Users and Product Providers or between Users;
9. Defamation of another party’s reputation;
10. Misuse of Products that Users have purchased;
11. Extra costs (including taxes and other fees) for all transactions that occur on itemku are the Users’ responsibility and are beyond the authority of itemku;
12. (If) Users Account, Balance and/or accounts are frozen and/or deactivated;
13. Misuse of contact numbers and/or email addresses belonging to Users or other parties;
14. Losses resulting from unauthorized payments to parties other than itemku official account who in any way use itemku name or negligence in writing down accounts and/or other information and/or negligence on the part of the bank;
15. Viruses or other malicious software (bots, scripts, other automation tools) obtained by accessing, or connecting to itemku services;
16. Any disruptions, bugs, errors or inaccuracies in itemku Services;
17. Damage to the Users’ hardware from the use of any Services on itemku Platform;
18. Content, actions or inaction of third parties, including those related to products on itemku Platform;
19. The occurrence of hacking action carried out by a third party on User Accounts;
20. Failure and/or disruption in the application of new technology and/or systems in devices facilities and/or internet networks owned and/or experienced by Users;
21. Itemku network disruption which cause the server down and requires maintenance and/or emergency maintenance on itemku Platform;
22. Misuse of a User Account that occurs due to the User’s negligence, including but not limited to lending the Account to another party, providing password access to another party, accessing links from another party, or other User negligence which results in losses or problems for the User;
23. Unavailability of services on itemku Platform at any time or for an undetermined period of time due to events beyond control of itemku;
24. Monitoring and control activities on the content of itemku Platform and/or resources that occur due to links (hyperlinks) in the product description. Itemku is not responsible for any loss and/or damage that may result from such actions.

Force Majeure

Itemku and any third party service providers are not responsible for failure or delay in carrying out its obligations under these Terms of Use arising from events resulting from a cause that is beyond the ability or control of itemku and/or the third party service providers (force majeure), also itemku has the right to cancel, postpone and make any changes to the Services and/or Platform caused by force majeure. Force majeure includes, among others:

mass work strikes, company closures, and other industrial actions;
riots, demonstrations, invasions, power struggles, sabotage, embargoes, drastic political/economic changes, terrorist attacks or threats, war (whether declared or not) or threats of preparations for war;
earthquakes, whirlwinds, landslides, floods, fires, explosions, storms, other natural disasters, outbreaks of an epidemic or pandemic nature whether or not confirmed by a statement from the competent authority;
promulgation of new statutory regulations that directly or indirectly affect the implementation of the Terms of Use;
unavailability or disruption of use of the Platform network (including transportation routes);
unavailability or disruption of telecommunications networks, information systems and technology, widespread internet network outages or unavailability, or being struck by lightning;
system failure caused by a third party that occurs outside the authority of the parties (e.g., system hacking by third parties and/or viruses);
actions, decisions, laws, regulations or restrictions issued by the government regarding the implementation of these Terms of Use;
changes to economic and financial conditions, as well as restrictions imposed by regulatory authorities regarding the use of the Services and/or Platform.

Updates and Modifications to Terms of Use

The Terms of Use of itemku, Terms and Conditions of itemku will change from time to time without prior notice. Users should read carefully and check the Terms of Use and Terms and Conditions page from time to time for any changes. In the event that Users do not agree to changes in the Terms of Use and/or Terms and Conditions, the Users have the rights to stop using itemku Platform.

By continuing to access and use itemku Platform and Services, Users are deemed to have agreed to any changes to itemku Terms of Use and/or Terms and Conditions.

Termination

Users are under no obligation to use Platform and may choose to stop using it at any time by canceling the Account and permanently deleting the Application from Users devices, thereby disabling the use of Application. The Terms of Use of itemku automatically end when the Users permanently terminate the Accounts by notifying itemku of the Users’ intention to cancel the User Account. Itemku will complete the termination within 14 (fourteen) working days.

Miscellaneous

Unless otherwise stated in these Terms of Use, the software required by Services or available at or used by our Platform and the intellectual property rights and Content and information as well as materials on the Platform are owned by itemku, its suppliers and providers.
Users cannot transfer their rights or obligations under these Terms of Use to other parties.

If, at any time, any provision in the Terms of Use is or becomes illegal, invalid or unenforceable in any respect under the applicable laws in the territory or any jurisdiction, then neither the legality, validity or enforceability of the remaining provisions nor the legality, validity or enforceability of these provisions under the laws of other jurisdictions will be affected or impaired.
